Terms of service

These Terms and Conditions (“Terms”) govern your access to and use of the website located at beautyoclock.ca (the “Website”), as well as your purchase or use of any products, consultations, treatments, procedures, appointments, memberships, packages, gift cards or other services offered by Beauty O’Clock Medical Spa Inc. (“Beauty O’Clock,” “we,” “us” or “our”).

By accessing the Website, booking an appointment, purchasing a product or service, or otherwise engaging with Beauty O’Clock, you acknowledge that you have read, understood and agreed to these Terms.

If you do not agree with these Terms, you must not use the Website or purchase or use our products or services.

1. Eligibility

You must be at least the age of majority in your province or territory of residence to make a purchase, book an appointment or consent to a treatment unless otherwise permitted by applicable law and approved by Beauty O’Clock.

You represent that all information you provide to us is complete, current and accurate. You must promptly notify us if any relevant information changes, including your contact information, payment information, medications, allergies, health conditions or medical history.

2. Medical and Aesthetic Services

Information presented on the Website is provided for general informational purposes only. It is not medical advice and is not a substitute for an individual consultation, diagnosis or treatment recommendation from a qualified healthcare professional.

Your eligibility for any treatment is subject to an individual assessment by an appropriately qualified Beauty O’Clock professional. We may refuse, postpone, modify or discontinue a treatment if we determine that it would be medically inappropriate, unsafe, unlikely to provide a reasonable benefit or otherwise unsuitable.

You agree to provide complete and accurate information about your health, medications, allergies, pregnancy or breastfeeding status, prior procedures and any other circumstances relevant to the proposed treatment.

Before receiving a treatment, you may be required to complete additional medical forms and sign a separate informed-consent document. If these Terms conflict with a treatment-specific informed-consent document concerning the medical risks or administration of that treatment, the treatment-specific document will govern those matters.

3. Treatment Results and Risks

Medical and aesthetic treatments may involve risks, side effects, discomfort, recovery time and complications. Treatment results vary between individuals and cannot be guaranteed.

Photographs, testimonials, descriptions, timelines and before-and-after images are provided for illustrative purposes only. They do not represent or guarantee the result that any particular client will achieve.

A client’s dissatisfaction with a subjective result, failure to achieve a desired outcome or need for additional treatment does not, by itself, establish that a service was improperly performed or entitle the client to a refund, credit or complimentary corrective treatment.

You are responsible for following all pre-treatment and post-treatment instructions. Beauty O’Clock is not responsible for adverse effects or reduced results caused or contributed to by inaccurate or incomplete information, failure to follow instructions, undisclosed medical conditions, another provider’s treatment or conduct outside our reasonable control.

If you experience an unexpected reaction or complication, contact Beauty O’Clock promptly. Seek emergency medical assistance when appropriate.

4. Appointments and Credit Card Authorization

We may require a valid credit card to be kept on file before confirming an appointment. By providing payment information, you represent that you are authorized to use the payment method and authorize Beauty O’Clock to charge amounts properly payable under these Terms.

Appointment availability is not guaranteed. Appointment times, treatment providers and treatment rooms may need to be changed for operational, medical or safety reasons. We will make reasonable efforts to notify you of material changes.

Please arrive on time. If you arrive late, we may shorten, reschedule or cancel the appointment. The full scheduled fee or applicable cancellation fee may still be charged.

5. Appointment Cancellations and Missed Appointments

Beauty O’Clock requires at least 24 hours’ notice to cancel or reschedule an appointment.

If you cancel or request to reschedule less than 24 hours before the scheduled appointment, arrive too late for the treatment to be safely or reasonably completed, or fail to attend the appointment, Beauty O’Clock may:

• retain any deposit;
• charge a cancellation fee equal to 50% of the scheduled treatment price or $50, whichever is greater; and
• require advance payment before accepting future bookings.

Cancellation and missed-appointment charges are separate from, and do not create an entitlement to, a refund of the underlying purchase.

Beauty O’Clock may waive a cancellation charge in exceptional circumstances at its sole discretion. A waiver in one instance does not require us to grant a waiver in any other instance.

If Beauty O’Clock must cancel an appointment, we will offer a reasonable opportunity to reschedule it. Our cancellation of an appointment does not make us responsible for travel expenses, lost income, childcare costs or other indirect expenses.

6. All Purchases Are Final

All purchases from Beauty O’Clock, whether completed online, in person, by telephone or through a third-party booking or payment platform, are final.

Except where otherwise required by applicable law:

• all payments, deposits, consultation fees, treatment fees, prepaid services, treatment packages, memberships, promotional purchases, gift cards and retail product purchases are non-refundable;
• purchases may not be exchanged, transferred to another person or clinic, converted to cash or applied toward a different product or service unless Beauty O’Clock agrees otherwise in writing;
• a change of mind, scheduling conflict, relocation, failure to use a purchased service, dissatisfaction with a subjective treatment result or failure to achieve a desired outcome does not entitle the client to a refund, exchange or credit;
• deposits paid for cosmetic injectable treatments and other reserved services are non-refundable;
• promotional prices, discounts and special offers cannot be applied retroactively to a completed purchase; and
• an unused or partially used package does not entitle the client to a refund for its remaining value.

If Beauty O’Clock determines that a purchased treatment cannot safely or appropriately be provided, we may, subject to applicable law, offer an appropriate substitute service, account credit or refund for the affected unprovided service.

Any exception granted by Beauty O’Clock is discretionary, applies only to the transaction for which it is granted and does not waive or modify this policy for any other transaction.

Nothing in these Terms limits or excludes a non-waivable right, remedy, refund, cancellation right, warranty or other consumer protection available under applicable law. If these Terms conflict with applicable law, the applicable law will prevail to the extent of the conflict.

7. Products

Clients are responsible for reviewing product ingredients, directions, warnings and storage requirements before use.

Except where otherwise required by law, retail products are final sale and cannot be returned or exchanged. If you believe that a product was defective when supplied, contact Beauty O’Clock promptly and retain the product, packaging and proof of purchase so that we can assess the matter.

Beauty O’Clock is not responsible for reactions caused by an undisclosed allergy, improper use, failure to follow product instructions, improper storage or use of a product after its expiry date.

8. Packages, Memberships and Prepaid Services

Packages, memberships and prepaid services are subject to any additional terms disclosed at the time of purchase.

Unless prohibited by law or otherwise stated in writing:

• packages and prepaid services may be used only by the original purchaser;
• services must be used at the Beauty O’Clock location identified at the time of purchase;
• package pricing applies only to the services included in the package;
• no refund will be provided for unused or partially used services;
• promotional or complimentary components have no cash value; and
• expired promotions or complimentary services will not be reinstated.

Any legally required expiry-date, cancellation or renewal rules will apply despite a conflicting provision in these Terms.

9. Gift Cards

Gift cards are not redeemable for cash and are non-refundable, except where required by law. Gift cards must be presented at the time of redemption and may be subject to additional purchase terms.

Beauty O’Clock is not responsible for a gift card that is lost, stolen, copied or used without authorization, except to the extent required by law.

Any restrictions, expiry dates or fees will apply only where permitted by applicable law.

10. Prices, Payments and Promotions

All prices are stated in Canadian dollars unless otherwise indicated. Applicable taxes and charges will be added when required.

Prices, promotions, treatment descriptions and availability may change without notice. The price confirmed at the time of purchase will apply to that transaction, subject to the correction of obvious errors.

Beauty O’Clock may cancel or correct an order affected by a typographical, technical, pricing or availability error. If we cancel an order after payment because of such an error, we will refund the amount charged for the cancelled item or service.

Promotions:

• are valid only during the stated promotional period;
• cannot be combined unless expressly permitted;
• have no cash value;
• cannot be applied retroactively;
• may be subject to eligibility, availability and treatment-suitability requirements; and
• may be modified or withdrawn where permitted by law.

You remain responsible for all authorized charges. Before initiating a payment dispute or chargeback, please contact Beauty O’Clock so that we have a reasonable opportunity to investigate and address the matter.

11. Online Orders and Redemption

Proof of purchase may be required to redeem an online purchase. We may also require government-issued identification or confirmation that the payment method belongs to the purchaser.

You are responsible for ensuring that all order, billing, contact and recipient information is accurate. Beauty O’Clock is not responsible for delays or losses caused by inaccurate information supplied by the purchaser.

An electronic order confirmation acknowledges receipt of an order but does not necessarily constitute acceptance. We may refuse or cancel an order for legitimate reasons, including suspected fraud, unauthorized resale, pricing errors, lack of availability or legal and safety concerns.

12. Website Use

Beauty O’Clock grants you a limited, revocable, non-exclusive and non-transferable right to access and use the Website for lawful personal purposes.

You must not:

• use the Website for unlawful, fraudulent or abusive purposes;
• interfere with the operation or security of the Website;
• introduce malicious code, viruses or other harmful technology;
• attempt to gain unauthorized access to an account, system or information;
• use automated tools to scrape, copy or index the Website without written permission;
• impersonate another person or submit false information;
• infringe the intellectual-property, privacy or other rights of Beauty O’Clock or any third party; or
• reproduce, distribute, modify, sell or commercially exploit Website content without authorization.

We may restrict or terminate access to the Website where we reasonably believe these Terms have been violated.

13. Accounts and Passwords

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Notify Beauty O’Clock promptly if you believe your account or password has been compromised. We may suspend or terminate an account to protect the client, Beauty O’Clock or another person.

14. Intellectual Property

The Website and its content—including text, photographs, graphics, logos, videos, designs, trademarks, software and other materials—are owned by or licensed to Beauty O’Clock and are protected by applicable intellectual-property laws.

No ownership rights are transferred to you. You may not copy, reproduce, modify, distribute, publish, display, create derivative works from or commercially use our content without prior written authorization, except where permitted by law.

15. Client Content and Submissions

If you voluntarily provide a review, testimonial, photograph, suggestion or other content, you represent that you have the right to provide it and that it is accurate, lawful and does not infringe another person’s rights.

Beauty O’Clock will not use identifiable clinical photographs for public marketing without any consent required by applicable law and professional standards.

Where you separately authorize us to use content for marketing, the applicable consent form will govern that use. You may contact us regarding withdrawal of consent, subject to applicable law and any use already lawfully completed.

16. Privacy

Our collection, use, retention and disclosure of personal information are governed by our Privacy Policy and applicable privacy legislation.

By using the Website or providing information to Beauty O’Clock, you acknowledge that your information will be handled in accordance with our Privacy Policy.

The Website and booking or payment systems may be operated partly through third-party service providers. Those providers may process information according to their own terms and privacy practices.

17. Electronic and SMS Communications

By providing your email address or telephone number, you consent to receive communications reasonably necessary to administer your account, purchases, appointments and care, including confirmations, reminders, receipts and post-treatment instructions, where permitted by law.

Marketing communications will be sent only with the consent required by applicable law. Consent to receive marketing messages is not a condition of purchasing a product or service.

Message frequency may vary. Standard message and data rates may apply.

You may withdraw consent to marketing text messages by replying STOP. You may request assistance by replying HELP or contacting us at:

After opting out, you may receive a confirmation message. Transactional, safety-related or service communications may still be sent where permitted by law.

You confirm that you are the subscriber or authorized user of any telephone number you provide. You must notify us if that number changes or is reassigned.

Mobile carriers are not responsible for delayed or undelivered messages.

18. Third-Party Websites and Services

The Website may contain links to third-party websites, booking platforms, payment processors or other services.

Beauty O’Clock does not control and is not responsible for third-party content, availability, security, products, services, terms or privacy practices. A link does not constitute our endorsement of the third party.

Your use of a third-party service is governed by your agreement with that provider.

19. Website Disclaimer

We make reasonable efforts to keep Website information accurate and current, but errors, omissions or delays may occur.

To the maximum extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis. Beauty O’Clock does not warrant that the Website will be uninterrupted, error-free, secure or free from harmful components.

Nothing in this section excludes a warranty, condition or obligation that cannot lawfully be excluded.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Beauty O’Clock and its directors, officers, employees, contractors and agents will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost income, lost profits, lost data or loss of opportunity, arising from the Website or a product or service.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any liability arising from fraud, wilful misconduct or any other matter for which exclusion is prohibited by law.

Any limitations applicable to medical or professional services remain subject to applicable legislation and professional obligations.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Beauty O’Clock and its directors, officers, employees, contractors and agents from third-party claims, liabilities, damages and reasonable costs arising from your unlawful misuse of the Website, infringement of another person’s rights or material violation of these Terms.

This provision does not require you to indemnify Beauty O’Clock for its own negligence, professional misconduct or violation of law.

22. Changes to Services and Terms

We may update the Website, products, services and these Terms from time to time.

Updated Terms will be posted on the Website with a revised effective date. Changes will apply prospectively from the stated effective date and will not retroactively alter a completed transaction where doing so would be prohibited by law.

Your continued use of the Website after updated Terms become effective constitutes acceptance of those Terms.

23. Suspension or Termination

Beauty O’Clock may refuse service, cancel future appointments or restrict Website access where reasonably necessary for medical safety, staff or client safety, suspected fraud, abusive or threatening conduct, non-payment or a material violation of these Terms.

Any decision to discontinue a clinical relationship will be handled in accordance with applicable professional and legal obligations.

24. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.

Subject to any mandatory consumer rights or other jurisdictional requirements, disputes relating to these Terms will be submitted to the courts located in Ontario, Canada.

25. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable. If that is not possible, it will be severed, and the remaining provisions will continue in effect.

26. No Waiver

A failure or delay by Beauty O’Clock in exercising a right under these Terms does not waive that right.

A waiver is effective only if it is given in writing by an authorized representative of Beauty O’Clock and applies only to the specific matter identified.

27. Entire Agreement

These Terms, our Privacy Policy, any applicable purchase or promotion terms, and any treatment-specific agreement or informed-consent form constitute the agreement between you and Beauty O’Clock concerning their respective subject matter.

If a provision of a treatment-specific document conflicts with these Terms, the more specific provision will govern the matter it addresses, subject to applicable law.
